Avenyx Terms of Service

Before You Read

These Terms of Service govern your use of Avenyx products and services, including PromptLens and Hoshi Travel. By creating an account or using any Avenyx product, you agree to these terms. If you do not agree, please do not use our services.

We wrote this to be readable — not buried in legalese. If something is unclear, email us at contact@avenyx.co and we'll explain it.

1. Who We Are

Avenyx is a technology company based in Oregon, United States, building human-centered software products at the intersection of artificial intelligence and human experience.

2. Eligibility

You must be at least 16 years old to use any Avenyx product or service. By creating an account, you represent that you meet this age requirement.

If you are using Avenyx products on behalf of an organization, you represent that you have the authority to bind that organization to these terms.

3. Your Account

When you create an Avenyx account, you are responsible for:

Providing accurate and complete information
Keeping your login credentials secure and confidential
All activity that occurs under your account
Notifying us immediately at contact@avenyx.co if you suspect unauthorized access to your account

We reserve the right to suspend or terminate accounts that violate these terms or that we believe have been compromised.

4. What You Can Do With Our Products

Avenyx grants you a limited, non-exclusive, non-transferable, revocable license to use our products for their intended purposes — personal productivity, team collaboration, and travel planning — in accordance with these terms.

You may:

Use PromptLens to analyze, improve, and track your AI prompts
Use Hoshi Travel to plan, manage, and share travel itineraries
Share access with team members through organizational features where available

5. What You Cannot Do

You agree not to:

Use our products for any unlawful purpose or in violation of any applicable laws or regulations
Submit prompts or content containing protected health information (PHI) belonging to others, sensitive PII you are not authorized to share, or any confidential information you do not have the right to disclose
Attempt to reverse engineer, decompile, or extract source code from any Avenyx product
Scrape, crawl, or use automated tools to access our services beyond their intended use
Use our products to harass, harm, or discriminate against any individual or group
Attempt to gain unauthorized access to any Avenyx system, account, or data
Misrepresent your identity or affiliation when using our services
Use our products in any way that could damage, disable, or impair our services or infrastructure
Resell or commercially exploit our products without written permission from Avenyx

6. Content You Submit

When you submit prompts, notes, itinerary details, feedback, or any other content through our products, you retain ownership of that content.

By submitting content, you grant Avenyx a limited license to process, store, and use that content solely to provide you with our services — including generating coaching feedback, usage analytics, and travel suggestions.

You are responsible for the content you submit. Do not submit:

PHI (Protected Health Information) under HIPAA
PII belonging to other people without their consent
Confidential business or legal information you are not authorized to share
Content that is illegal, threatening, or harmful

Avenyx is not liable for sensitive information you voluntarily submit through our platform.

7. PromptLens — Specific Terms

PromptLens is a prompt coaching and AI usage tool. When using PromptLens:

Prompt analysis and coaching is provided for informational and productivity purposes only
Avenyx does not guarantee specific outcomes from improved prompts
Team and organizational usage data is visible to account administrators and managers within your organization as described in the product
We do not use your prompts to train third-party AI models

8. Hoshi Travel — Specific Terms

Hoshi Travel is an AI-assisted travel planning application. When using Hoshi Travel:

Location data is used in real time to provide travel suggestions and organize your itinerary
AI-generated suggestions are recommendations only — Avenyx is not responsible for the accuracy, availability, pricing, or quality of suggested locations, stores, or activities
Budget estimates are approximations based on information you provide and are not guaranteed to be accurate
Shared trip features allow other users you invite to view and collaborate on your itinerary — be thoughtful about who you share with

9. Intellectual Property

All Avenyx products, including their design, code, branding, logos, and content created by Avenyx, are owned by Avenyx and protected by applicable intellectual property laws.

You may not use the Avenyx name, logo, or branding without our written permission.

10. Third-Party Services

Our products may integrate with or link to third-party services. Avenyx is not responsible for the content, privacy practices, or terms of any third-party service. Your use of third-party services is governed by their own terms and policies.

11. Beta Products

Some Avenyx products, including PromptLens, may be offered in beta. Beta products are provided as-is and may contain bugs, errors, or incomplete features. By using a beta product, you acknowledge that:

The product is still in development and may change significantly
We may discontinue beta access at any time
Data from beta periods may not be preserved through product updates

Your feedback during beta is valuable and helps us build better products.

12. Disclaimers

Our products are provided as-is and as-available. To the fullest extent permitted by law, Avenyx disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not guarantee that:

Our services will be uninterrupted, error-free, or secure
Results from using our products will meet your specific expectations
Any data stored through our services will never be lost

13. Limitation of Liability

To the fullest extent permitted by applicable law, Avenyx will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our products — including loss of data, loss of profits, or damages resulting from content you submit.

Our total liability to you for any claim arising from these terms or your use of our products will not exceed the amount you paid to Avenyx in the twelve months preceding the claim, or $100, whichever is greater.

14. Indemnification

You agree to indemnify and hold harmless Avenyx, its founders, employees, and contractors from any claims, damages, or expenses (including legal fees) arising from your use of our products, your violation of these terms, or your submission of content that violates the rights of others.

15. Termination

You may close your account at any time by contacting us at contact@avenyx.co.

We may suspend or terminate your access to our products at any time, with or without notice, if we believe you have violated these terms or if we discontinue a product or service. Upon termination, your right to use our products ends immediately.

16. Changes to These Terms

We may update these Terms of Service as our products and business grow. When we make significant changes, we will notify you by email or through a notice in our products. Continued use of our services after changes are posted means you accept the updated terms.

17. Governing Law and Disputes

These terms are governed by the laws of the State of Oregon, United States, without regard to its conflict of law principles.

Any disputes arising from these terms or your use of Avenyx products will be resolved through good-faith negotiation first. If we cannot resolve a dispute informally, it will be subject to the exclusive jurisdiction of the courts located in Oregon.
